Established pursuant to § 51.5-149.1 of the Code of Virginia, the Public Guardian and Conservator Advisory Board reports to and advises the Commissioner of DARS on the Virginia Public Guardian and Conservator Program.
Purpose
The purpose of the Public Guardian and Conservator Advisory Board (PGCAB), as established by § 51.5-149.1 of the Code of Virginia, is to report to and advise the Commissioner of DARS on the means for effectuating the purposes of §§ 51.5-149 et seq., and to assist in the coordination and management of the local programs appointed to act as public guardians and conservators pursuant to Chapter 20 (§ 64.2-2000 et seq.).
Power
and Duties
Pursuant to § 51.5-149.2, the Board has the power and duty to:
- Assist in the coordination and management of the local and regional programs appointed to act as public guardians and conservators
- Provide advice and counsel on the provision of high-quality guardianship service and avoidance of conflicts of interest
- Promote the mobilization of activities and resources of public and private sector entities to effectuate the purposes of the Virginia Public Guardian and Conservator Program
- Make recommendations regarding appropriate legislative and executive actions to enhance and improve the Virginia Public Guardian and Conservator Program
- Submit to DARS by October of each odd-numbered year a report (“biennial report”) regarding the activities and recommendations of the PGCAB

Committees
The Legislative Committee is responsible for crafting recommendations related to potential legislation and budget items affecting the Virginia Public Guardian and Conservator Program. - Nominating Committee
The role of the Nominating Committee was to determine a slate of nominees for Board Chair and Vice-Chair for consideration at the first Quarterly meeting of each fiscal year (“annual meeting”). Additional nominations, with the consent of the nominee, were accepted from the floor. The Nominating Committee was eliminated in 2024. Nominations for Chair and Vice-Chair are now accepted from the floor at the annual meeting, followed immediately by elections.
